These Terms of Service (the “Terms”) work together with our Privacy Policy and Refund/Returns Policy. By visiting or using the Services, you agree to these Terms and those policies. If you do not agree, please do not use the Services.

You’re responsible for safeguarding your login and all activity under your account. You must not transfer or sell your account.

An order is formally accepted when we send a shipping confirmation or similar explicit notification that the products have been dispatched. Payment processing does not constitute acceptance. Review your cart before submitting, as changes or cancellations may not be possible after acceptance. If we adjust or cancel your order (e.g., due to stock issues or errors), we’ll notify you using the details provided at checkout. Returns are handled per our Refund/Returns Policy. Purchases are for personal/household use, not resale or export.
4. Prices and Billing
Prices, discounts, and promotions may change without notice. The price charged is the price in effect at ordering and will appear in your confirmation email. Unless stated otherwise, prices exclude taxes, shipping/handling, and duties. Online prices may differ from other channels. You agree to provide valid payment details, are authorised to use them, and will pay all amounts due (including taxes and shipping).

Delivery Timeframes are Estimates: All stated delivery time-frames are estimates only and are not guaranteed.

Delays: We are not responsible for delays caused by third-party carriers, adverse weather conditions, public holidays, customs processes, or any other events outside of our reasonable control.

Transfer of Risk and Ownership (Title): Title (ownership) and the risk of loss or damage to the parcel pass to you (the customer) once the goods are handed over to the carrier for shipment, except where the Australian Consumer Law (ACL) provides otherwise.

Holding Period: During warmer periods, we may, at our discretion, hold temperature-sensitive items (e.g., chocolate) to prevent them from being stored in a non-refrigerated warehouse over a weekend. Please contact us for urgent shipping options if required.

Risk of Spoilage: While we take reasonable preventative steps (such as holding items during warmer periods as described above), we are not liable for spoilage (e.g., melting or degradation) that occurs once the parcel is transferred to the carrier.
Note: The customer assumes the risk of shipping in unsuitable weather, especially if a specific delivery time-frame or method is requested.
6. Intellectual Property
All content on the Services (including trademarks, text, graphics, images, video, audio, design, and layout) is owned by British Sweets & Treats or our licensors. You may use the Services for personal, non-commercial purposes only. No licence is granted except as expressly stated in these Terms. “British Sweets & Treats” names and logos are our trademarks; Shopify’s marks are those of Shopify. Other marks belong to their owners.
7. Optional Tools
We may offer access to third-party tools/features on an “as is” and “as available” basis without warranties or endorsements. Your use is at your discretion and subject to those third parties’ terms.
8. Third-Party Links
The Services may link to third-party sites or display third-party content. We don’t control and aren’t responsible for such content or sites. Access at your own risk and review their policies before transacting.
9. Relationship with Shopify
Our store is powered by Shopify, but your purchase is with British Sweets & Treats. Shopify is not a party to your transaction and isn’t responsible for sales between you and us.
10. Privacy
We handle personal information per our Privacy Policy. Because our store is hosted by Shopify, Shopify also processes certain personal information—see Shopify’s privacy notices for details.
11. Feedback and Reviews
By submitting reviews, ideas, or other content (“Feedback”), you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, and display that Feedback for lawful purposes. You warrant you have the rights to submit it and that it complies with these Terms. We may moderate or remove Feedback at our discretion.
12. Errors and Availability
Information may occasionally contain errors or omissions (e.g., pricing, availability, transit times). We may correct or update this information, and cancel orders affected by such errors, subject to applicable law.
13. Prohibited Uses
You must use the Services lawfully and not: violate laws or third-party rights; harass or harm others; transmit malware or spam; scrape or attempt unauthorised access; interfere with security; or misuse the Services (including unauthorised resale). We may suspend or terminate access for violations.

We may suspend or terminate your access at any time. You remain liable for amounts due up to the termination date. Sections intended to survive termination will continue to apply.
15. Disclaimer of Warranties
Except as required by law (including the ACL), the Services and all products are provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, we do not guarantee uninterrupted, timely, secure, or error-free operation.
16. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential losses arising from your use of the Services or products. This includes, without limitation, loss of profit, loss of data, or loss of business opportunity arising from your use of the Services or products.
Australian Consumer Law (ACL)
Nothing in this clause limits any liability that cannot be excluded under the ACL. Where our liability can be limited by law, it will be restricted to, at our option, the repair, replacement, resupply of the Services/products, or a refund, as provided under the ACL.
17. Indemnification
You agree to indemnify and hold harmless British Sweets & Treats and our related parties from claims or losses arising from your breach of these Terms or unlawful use of the Services.
18. Severability
If any provision is unenforceable, it will be enforced to the maximum extent permitted, and the remainder will continue in effect.
19. Waiver; Entire Agreement
Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Refund/Returns Policy, are the entire agreement between you and us regarding the Services.
20. Assignment
You may not assign your rights or obligations without our written consent. We may assign or transfer ours at any time.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts with jurisdiction over appeals.

Headings are for convenience only and do not affect interpretation.
23. Changes to These Terms
We may update these Terms by posting a revised version on this page. Where required by law, we’ll notify you of material changes. Your continued use of the Services after changes take effect constitutes acceptance.
